This Privacy Policy explains how Yellow Works B.V., owner and organizer of The EMEIA CFO Association (TECA) and administrator of the website, collects, uses, and protects personal data.

TECA processes personal data in accordance with the General Data Protection Regulation (GDPR) (EU) 2016/679 and the Dutch “Algemene verordening gegevensbescherming” (AVG) and treats all personal information with the utmost care.

1.      Personal data we collect

We may collect and process the following personal data when you interact with TECA, become a TECA member, register for events or subscribe to communications:

  • Name and contact details (first name, last name, email address, phone number)
  • Company information (company name, company annual revenue, postal address)
  • Address information (if different than company address)
  • Name and contact details of your Executive Assistant (first name, last name, email address, phone number)
  • Event participation information
  • Pictures and videos taken during TECA events
  • Invoicing and payment details
  • Technical data such as IP address, device information and cookies
  • Any additional information you voluntarily provide

TECA does not process special categories of personal data, such as data related to ethnic origin, religion or political opinions. Health related information, such as allergies or dietary requirements, will only be stored based on your explicit consent and only as long as relevant for the organization of a specific event.

2.      How do we receive your data

We have received the above personal data either from yourself, your Executive Assistant or from public registers, like the Chamber of Commerce or other open sources (internet, social media).

3.      Why we process your data

We use your personal data only when we are allowed to do so according to the GDPR and the Dutch AVG (‘Algemene Verordening Gegevensbescherming’) for the following purposes:

3.1  Contact

If you have contacted us via telephone, email, contact form, WhatsApp, or social media, we will have received your personal data. We process this data in order to respond to your message. If you contacted us via social media, this will usually have been through the personal account of Frank Geelen. In that case, it is considered personal or household use. In all other cases, we retain the data for a maximum of 5 years, for example to see when we last had contact, what it was about, and how you responded at the time. It is in our legitimate interest to know this, so that we can assist you better and set priorities more effectively.

3.2  Newsletter & Information

As a TECA member, one of your benefits is to receive the quarterly TECA newsletter. We therefore process your name and mail address to send you information and news as included in the TECA newsletter. Each newsletter contains the option for you to unsubscribe.

3.3  Invoices

If you have become a TECA member, we process the data necessary to fulfill our obligations under the service agreement. Those are in any case your name and email address and any other data necessary to send a correct invoice. Upon payment we will see from which bank account this is coming and who is the holder of the account. We keep invoices and payment details for 8 years resulting from Dutch tax law requirements.

3.4  Service agreement

Besides for sending newsletters and invoices, we sometimes need your data to fulfill the agreement itself. We use your data to manage registrations for TECA events and activities and communicate with you regarding our services and events.

3.5  Marketing

We may use your name for marketing activities, for example towards potential new members of TECA, potential speakers at TECA events and potential knowledge partners. In particular, we would like to mention your name as a member of TECA towards other potential new members, all CFOs of EUR 10b+ companies and organisations in the EMEIA region. In case you would like us to refrain from doing so, please let us know in writing to our email address members@theemeiacfoassociation.com.

3.6  Statistical purposes

For statistical purposes, limited website visitor data may be stored.

3.7  Legitimate interest and data retention

We may use your data for improving our services and events through analysis and feedback as well as for other legitimate business interests.

We have carefully balanced our interests – such as protecting our evidentiary and legal position- against the privacy rights of the individual whose personal data is processed on this basis. In doing so, we ensure that only the data necessary to achieve our purpose is processed, while safeguarding our legitimate interests.

We retain personal data only for as long it is necessary to fulfill the purposes for which it is collected, unless a longer retention period is required by law.

3.8  Publication on the members-only part of the TECA website

Pictures, videos, report-outs and presentations given during the TECA events might be published on the ‘Members-only’ part of the TECA website. Next to this, we intend to publish your name, organisation and email address on the ‘Members-only’ part of our website.

The ‘Members-only’ part of the TECA website is only accessible for members using their email and password. A TECA member can always object to being mentioned on the TECA ‘Members-only’ part of the website by writing to the members@theemeiacfoassociation.com email address.

4.      Transfer of personal data

4.1 Recipients of your personal data

We might share your data with the following third parties, including our processors:

·       Hosting our website

·       WordPress

·       CRM system for event and participation management

·       Email marketing software for newsletters and communication

·       Visitor registration systems for events

·       Survey tools to collect feedback and improve events

·       Accountant

·       Email service providers

·       Telecommunication service providers

·       Payment service providers

·       Delivery service providers

·       Printing agencies

·       Organisations receiving members of TECA

·       Potential new members, speakers and knowledge partners.

4.2. Transfers to Third Countries

We aim to process personal data as much as possible within the European Economic Area (EEA), but in some cases we cannot avoid using services from providers located outside the EEA.

When third parties process data on our behalf, we ensure appropriate DATA Processing Agreements are in place.

4.3 Sharing personal data

Personal data is only shared with third parties when necessary to:

·       manage events or payments

·       comply with legal obligations

·       market TECA towards potential new members, speakers or knowledge partners.

5.      Your Rights

We like to inform you about your rights and the influence you can exercise over the processing of your personal data. If you wish to exercise any of these rights, please contact us via email members@theemeiacfoassociation.com.

We may ask for identity verification before processing your request.

5.1 Access, rectification and erasure

You have the right to know which personal data we process about you, and you may subsequently request that this data be corrected or deleted.

5.2 Restriction of processing

You have the right to request that we restrict the processing of your personal data, for example, when the data is no longer accurate, the processing is unlawful, we no longer need your personal data or pending a decision on an objection you have made to the processing.

5.3 Right to object

You have the right to object to the processing of your personal data. If you object to the use of your personal data for marketing purposes, we will no longer use your personal data for such purposes.

5.4 Data portability

You have the right to receive your personal data from us in a structured, commonly used and machine-readable format, so that you can transfer it to another party.

5.5 Withdrawal of consent

Where we have obtained your data for a specific purpose based on your consent, you have the right to withdraw that consent at any time. The withdrawal of consent does not affect the lawfulness of processing carried out before the withdrawal.

5.6 Complaints

Do you have complaints about how we handle your personal data? You have the right to lodge a complaint with the Dutch Data Protection Authority (‘Autoriteit Persoonsgegevens’).

6.      Cookies and links

6.1 Cookies

Cookies are small text files stored on your device when visiting a website. The information stored in the cookie may be returned to our website when you visit the website again. TECA uses only cookies that are necessary to ensure that TECA’s website functions properly. They enable basic features such as page navigation and access to secure areas of the website. Without these cookies, the website cannot function correctly.

Our website may contain links to external websites. By clicking on a link, you will be redirected to a website outside of this website. These external websites may use cookies. We therefore refer you to the cookie or privacy statement of the respective website.

7.      Data security

TECA takes appropriate technical and organisational measures to protect personal data against misuse, loss, unauthorized access, or disclosure.

If you suspect that your data is not properly secured, please contact us immediately.

8.      Changes to this privacy statement

This Privacy Statement may be updated from time to time as needed. Any changes will be published on the TECA membership website. Unless otherwise provided by mandatory applicable legislation, we may not notify changes to the data subjects in person.

9.      Applicable law and jurisdiction

The processing of personal data in TECA’s filing system is governed by the EU’s applicable data protection legislation as well as the Dutch Data Protection Act. The court of Utrecht, the Netherlands has exclusive jurisdiction to settle any dispute arising out of or in connection with this privacy statement.
